Acceptable Use Policy

ACCEPTABLE USE POLICY

1. AUP. This Acceptable Use Policy (the “AUP”) governs your access to or use of the hosted platform and mobile application that powers artificial intelligence search, chat, and copilot experiences for software products (the “Platform”) of Inkeep, Inc. (the “Provider”). This AUP provides guidance on what constitutes misuse of the Platform.

2. Prohibited Activities. You shall be prohibited from using the Platform or any other services provided by Provider:

3. for any unlawful purpose;

4. to conduct any unlawful acts or solicit others to perform or participate in any unlawful acts;

5. to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;

6. to use the Platform for any purpose or in any manner that infringes upon or violates the rights, including but not limited to intellectual property rights, of Provider or any third party;

7. to harass, abuse, insult, harm, defame, slander, stalk, threaten, disparage, intimidate, discriminate in any way, including, but not limited to, discrimination based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability, or otherwise violate the legal rights (such as of privacy or publicity) of any other users of the Platform or Provider’s employees, affiliates, or partners or the employees, affiliates, or partners of any other platform or integration with which Provider does business;

8. to submit false or misleading information;

9. to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Platform or of any related website, other websites, or the Internet;

10. for any obscene or immoral purpose;

11. to interfere with or circumvent the security features of the Platform or any related website, other websites, or the Internet;

12. to interfere with or carry out any activity that threatens the performance, security, or proper functioning of the Platform;

13. to attempt to compromise the system integrity or security or decipher any transmissions to or from the servers running the Platform;

14. to attempt to access unauthorized accounts or to collect or track the personal information of others;

15. to abuse any trial offerings with respect to the Platform;

16. to abuse any rebate offerings with respect to the Platform;

17. in any way that violates the policies of any other platform or integration with which Provider does business;

18. to copy, distribute, or disclose any part of the Platform in any medium other than as allowed by the Platform and any terms of use governing your use of the Platform;

19. to use any automated system (other than any functionalities of the Platform), including without limitation “robots,” “spiders,” “offline readers,” etc., to access the Platform;

20. to transmit spam, chain letters, or other unsolicited email or attempt to phish, pharm, pretext, spider, crawl, or scrape;

21. to impersonate another person or otherwise misrepresent your affiliation with a person or entity, conduct fraud, hide, or attempt to hide your identity;

22. to attempt to decipher, decompile, disassemble, or reverse engineer any of the software or algorithms used to provide the Platform;

23. to develop any artificial intelligence or machine learning models that compete with Provider or any features and capabilities offered as part of the Platform that utilize artificial intelligence, machine learning or similar technologies developed by Provider and/or Provider’s third-party providers (the “AI Functions”) or develop any internal models intended to replace use of Provider’s Platform;

24. to provide, submit or upload any textual, audio, or visual content, information, and materials that contains Excluded Data to the Platform for use with the AI Functions;

25. to mislead any person that output generated and returned by the AI Functions from the Platform was solely human-generated;

26. in a manner that violates any technical documentation, usage guidelines, or parameters;

27. to make automated decisions that may have a detrimental impact on individual rights without appropriate human supervision; or

28. to encourage or enable any other individual to do any of the foregoing.

As used herein, “Excluded Data” means (a) categories of data listed in European Union Regulation 2016/679, Article 9(1) or any successor legislation, (b) patient, medical, or other protected health information subject to the Health Insurance Portability and Accountability Act (as amended), (c) any financial data or payment card data subject to the Payment Card Industry Data Security Standards, (d) any information subject to regulation or protection under specific laws, rules or regulations, such as the Children’s Online Privacy Protection Act or the Gramm-Leach-Bliley Act, (e) social security numbers, driver’s license numbers, or other government ID numbers, or (f) any sensitive personal data protected under foreign or domestic laws.
